Moovit App Global Ltd. and its affiliates (“Moovit”, “we”, or “our”) invites you to use our Safe Ride services made available via our mobile App and associated web application (“WebApp”) and related public transportation information services (collectively referred to as the “Safe Ride Service,” as further detailed below). Capitalized terms which are not defined herein shall have the meaning ascribed to them in our Terms of Service.
By accessing or using the Safe Ride Service:
In the event that you choose to use additional services provided by Moovit, you will also be subject to additional terms and conditions, as shall be provided in connection with such additional services, as applicable. In such case such additional terms shall be considered as part of these Safe Ride Terms.
IF YOU DO NOT AGREE TO THESE Safe Ride TERMS, PLEASE DO NOT CONNECT, ACCESS, DOWNLOAD, OR USE THE Safe Ride SERVICE IN ANY MANNER.
By acceptance of these Safe Ride Terms, you represent that any and all information you provide to us through the Safe Ride Service is true and accurate. The provision of any false or fraudulent information is strictly prohibited.
You further consent to receive communications from us electronically. We may communicate with you in a variety of ways, such as by e-mail, in-app push notifications, SMS messages, or by notices and messages on the Moovit website. You may revoke your consent to any individually targeted communications at any time.
1. Safe Ride Service
PLEASE NOTE: THE APP MAKES USE OF DETAILED LOCATION AND ROUTE INFORMATION, INCLUDING IN THE FORM OF GPS SIGNALS AND OTHER INFORMATION SENT BY YOUR MOBILE DEVICE ON WHICH THE Safe Ride SERVICE IS ACTIVATED. CERTAIN FEATURES OF THE Safe Ride SERVICE CANNOT BE PROVIDED WITHOUT THIS TECHNOLOGY. THIS IS DESCRIBED IN FURTHER DETAIL IN THE MOOVIT PRIVACY NOTICE.
In addition to the public transit information and trip-planning services Moovit provides via its App, Moovit provides Users who have subscribed to Moovit+ (visit https://support.moovitapp.com/hc/en-us/articles/10011559836818 for more information) the ability to designate and permit certain safety contact persons (“Safety Contact(s)”) to track the User’s progress on designated routes using real-time location data when riding public transit in Moovit-supported regions, all directly from the App or Webapp (collectively, the “Safe Ride Service”).
2. User Account
In order to use the Safe Ride Service as a transit rider, you must possess a registered User Account with Moovit with an active subscription to Moovit+ (visit https://support.moovitapp.com/hc/en-us/articles/10011559836818 for more information). You are solely responsible for maintaining the security of your User Account name and password and for all activity that occurs on your User Account. For more information on the term and conditions governing your User Account, please review the Moovit Terms of Service.
3. Registering Your Safety Contact
To invite your desired contact person to participate in the Safe Ride Service as a potential Safety Contact, you will be required to provide certain contact information, including their name and mobile phone number. Moovit will then notify your designated contact person to obtain their lawful consent to participate in the Safe Ride Service by completing their registration as your Safety Contact. You acknowledge and agree that if your designated contact person does not complete their registration to the Safe Ride Service within a reasonable amount of time from Moovit’s notification, they will not be registered as your Safety Contact and Moovit will cease further communications with such person.
You further represent and warrant to Moovit at all times throughout your use of the Safe Ride Service that: (i) to the extent you have provided Moovit the contact details or other personal information of a potential Safety Contact, you have full authority and possess all necessary rights or permissions to do so; and (ii) you understand and agree that the Safe Ride Service permits your designated Safety Contacts to track your real-time location on your designated route.
4. Safety Contact Obligations
Once registered as a Safety Contact for a User, the Safety Contact consents to receiving SMS messages and other forms of electronic communications and notifications from Moovit, in accordance with the Safe Ride Privacy Policy Safety Contact acknowledges that their carrier’s standard message rates and data charges may apply.
Safety Contact further warrants and represents to Moovit at all times throughout the use of the Safe Ride Service that: (a) the User on behalf of which the Safety Contact is registered is personally known to the Safety Contact; (b) the use of the Safe Ride Service shall be in compliance with all applicable laws and court orders, including without limitation all privacy laws; and (c) in the event of an actual or suspected emergency involving the User, the Safety Contact will promptly alert the relevant local authorities or emergency services.
5. Privacy and Data
Moovit respects your privacy and is committed to protect the information you share with it. Our policy and practices with respect to the Safe Ride Service and the type of information collected are described in our Safe Ride Privacy Policy. If you intend to connect to, access, or use the Safe Ride Service you must first read and agree to the Safe Ride Privacy Policy.
6. Disclaimer of Liability
EACH OF USER AND SAFETY CONTACT HEREBY ACKNOWLEDGE BY AGREEING TO THESE Safe Ride TERMS THAT MOOVIT AND ITS AFFILIATES, INCLUDING ANY OF THEIR OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS, LICENSORS, AGENTS, PARENT COMPANIES, SUBSIDIARIES AND OTHER AFFILIATES (COLLECTIVELY, “MOOVIT PARTIES”) PROVIDE NO WARRANTIES AS TO THE PERFORMANCE, CORRECTNESS, FUNCTIONALITY, OR SUITABILITY OF THE Safe Ride SERVICE FOR ANY PARTICULAR PURPOSE. THE MOOVIT PARTIES DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE, THE INABILITY TO USE OR OPERATE, OR THE RESULTS OF THE USE THE Safe Ride SERVICE. THE Safe Ride SERVICE (AND ANY PART THEREOF), INCLUDING WITHOUT LIMITATION ANY CONTENT, DATA, AND INFORMATION RELATED THERETO, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF TITLE OR NON-INFRINGEMENT OR IMPLIED WARRANTIES OF USE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE. THE MOOVIT PARTIES DO NOT WARRANT THAT THE USE OR OPERATION OF THE Safe Ride SERVICE IS OR WILL BE SECURE, ACCURATE, COMPLETE, UNINTERRUPTED, WITHOUT ERROR, OR FREE OF VIRUSES, WORMS, OTHER HARMFUL COMPONENTS, OR OTHER PROGRAM LIMITATIONS.
7. Termination
Either of User or Safety Contact may terminate their participation in the Safe Ride Service at any time by either following the prompts presented through the User Account on the App or “unsubscribe” link presented through the WebApp, as applicable, or by sending an email to support@moovit.com indicating their desire to discontinue use or participation in the Safe Ride Service.
